Can boy's parent file a case on boy to pay them monthly maintenance as they are dependant on their son instead of paying maintenance to their son's wife. Intention of boy's family is to not to pay maintenance amount to wife as she us already working.

You can file petition under section 397 CrPC for dismissing order of maintenance as she is able to take care of herself and she had hidden the facts at the time of filing 125 crpc petition.

The solution which you are thinking won’t work.

Yes parents can seek maintenance from their son by filing case in the proper court of law but wife can also seek maintenance from her husband and it can divided as per the income and expenditure of the son/husband. there is no provision that you can deny for maintenance but if wife is working thn the amount will be decided accordingly. rest call me will discuss it over phone and you can come to my office for the discuss.

hello sir/ madam. I went through your query. either son or daughter, both are liable to taje care of the parents and the parents can file for maintenance of there son is not maintaining them. secondly being a husband the son is equally liable to pay the maintenance to his wife. the amount of the maintenance fixed can be reduced on the fact that she is working. hope this was helpful. for further legal guidance you can contact me.
