Married in arya samaj mandir is it a legal marriage

hi i got married with my boyfriend on 2 Nov 2006 in Arya samaj mandir, after marriage we didn't told anyone about this.Later i got to know that he is getting married with some other girl. in 2010 i also got married now my husband want to apply for marriage certificate as i have not taken divorce from my x-boyfriend will there be any issue?i am very worried.i had a word with my X-boyfriend he said we have not applied for any certificate so there will be no issue for marriage certificate , can you please confirm the same.

Yes marriages in the arya samaj mandir are valid marriages and they only can be held void by court of law. Infact your second marriage is not valid in the eyes of law and vaidable marriages. You can not claim rights over your second husband in fact you are in big trouble bcoz of your decision

Certificate or not, your marriage at the Arya Samaj mandir is a legally valid marriage, assuming that you have undergone all the ceremonies required for a valid Hindu marriage. Your course of action will be to produce proof of this marriage (the Arya Samaj Mandir usually gives a certificate), file a petition for divorce, get the divorce, and then get remarried. Any marriage which either you or your ex-boyfriend go through is not valid in law.

Arya Samaj marriage is legally valid one and is admissible in court of law. Frankly telling you and your x-boy friend were legally wed couple. without cancelling the same you both again got married which is punishable in the eyes of law. even if u have not got any certificate you must have signed in the Registrar at the time of Arya samaj marriage. If someone make an issue out of it then it will bring trouble. However since you both got married to somebody else and hope both you and your x-boy friend would not interfere into other affair you simply forget the past and lead a life as if you never met and married to the persons with whom you are. But strictly speaking it is punishable for bigamy i.e marrying another person when your spouse is alive under the Indian Penal code provisions and punishable for conceding the facts with your present partner.

Hi, As you and your ex- boyfriend(ex-husband) had not taken divorce before getting married to some other person therefore the second marriage is automatically is null and void as the first marriage was not dissolved. so you have first to take divorce from your first husband after that you or your present husband can apply for certificate of marriage .In case if you apply for registration of marriage at present then the same will be non-effective.

As per hindu law this a valid marriage and you should obtain a decree of divorce from the competent court of law. And this is a committed offence of bigamy. It is better option if the arya samaj marriage documents out of reach from any person
