My wife filed fake complaints of 498a and DV against me in women cell in April of 2019. Currently the case is in Mediation Court. If it doesn't get resolved here, then an FIR will be lodged for sure.. I have spoken to many lawyers on my case. Some say that I need to get a rented Accomodation and also I have to get disowned from the property, however some say that it's not required due to the fact that the property belongs to my father, not me... Can anyone please give me a detailed information as to why it is required for someone to get a rented Accomodation and needs to get disowned.. My mom loves me a lot as I am the only son she has and she doesn't want me to have a rented Accomodation. So please provide me some legal help on this. I would highly appreciate it.

No need to do any of the above. Just sit back and relax, it's only mediation and the same does not have binding value. As far as the FIR is concerned, an FIR once lodged does not guarantee conviction, and it may be quashed once sufficient cause for doing so is shown. Further and better particulars are needed for an effective opinion.

Query perused. See as per law a husband is legally bound to maintain her wife and kids. Since she has filed a DV complaint she must have sought maintenance, separate residence order and compensation. If due to alleged domestic violence she doesn't want to stay at matrimonial house, she is entitled to a separate rended accommodation and the expenses will be borne by you. The lawyers may ask you to move out on a seperate accomodation as then your parents and you wont be sharing the same shared household.
