All the issues are sorted....I haven't filed a petition yet....when will the family court in Bangalore open...and how much time will it take for the decree to be granted...if we appeal for waiving of 6onths cooling period....can the cooling period be waived off?

The courts are open from June 1st. If both parties are agreeing for MCD it can be filed. The waiver of 6 months cooling period is discretion of judges and cases to case basis. This is an effort only to opt in the case. The decision to waive of 6 months time period is not mandatory. If the waive off period is permitted it may take 30 days time period approximately.

the courts are taking emergency matters and even filing on prior appointments , you cannot appeal for waiving 6 months , you have to make application with proper grounds and reasons , then only court will consider your application.

Family courts in Bangalore are started functioning since 1st June. To file MCD you require one year of separation and after filing case it will take 6months of time to get orders from court. It depends on facts and circumstances of the case the courts will waive off 6 months statutory period.
