How to resolve husband 's extra marital affair
27-Sep-2024 (In Divorce Law)
My husband is having an affair since last 8 years. He told me about it nearly two years back. He wants to stay with us ( me n my 2 kids) but the lady is not ready to breakup or move on. She is threatening to commit suicide, so my husband has to maintain contact with her. I don't want divorce as my kids future is at stake. I just want to know is there any legal way to stop this affair.
This is a complex and sensitive situation, both legally and personally. Since you want to avoid divorce and preserve the future of your children, you may consider the following legal options:
1. Legal Notice: You can send a legal notice to the woman involved, warning her against interference in your family life. This is not a legal case but a step to establish your stance and create a record of your objections.
2. Criminal Complaint: If the woman is harassing your husband or making threats, your husband can file a criminal complaint against her for harassment or blackmail under Sections 503 and 506 of the Indian Penal Code.
3. Counseling and Mediation: Sometimes legal measures may escalate the issue. It might be beneficial to involve a counselor or mediator who can help facilitate a resolution that involves the safety and well-being of all parties.
4. Injunction or Restraining Order: If her threats persist and are affecting your family, your husband can seek a restraining order against her to prohibit any further communication or contact.
5. Recording Evidence: Maintain records of all communications and threats made by the woman. This evidence could be critical if the situation escalates or if you decide to pursue legal action.
Before taking any steps, it's advisable to consult a family lawyer who can help strategize a legal response tailored to your specific circumstances. This will ensure that any action taken will not jeopardize your family's future or cause legal complications for your husband.
