How to get Divorce without mutual consent

Sir/Madam, Five years before my wife and son left me taking all the jewels and other things without my knowledge with her parents after one of my relative went to her home and asked about this they said my daughter is not feeling well so she will be in there home for one year after that they didn't returned and also not allowed to see my son after that I filed conjual rights case for one year they didn't appeared case become expartie in my favour after that I waited for one year now I filed divorce case for two hearings they didn't appeared but now one lawyer appeared on their side. We tried for peacefully solve the case thru mutual consent but they refused. Now how can I get divorce, pls help me

you have to contest the case. you can file a speedy disposal of the case at Madras High court by way of CRP proceedings. since conjugal rights in your favour and you have filed divorce proceedings it will take time to get divorce.

Sir I would request you to send a legal notice to your wife mention in the order in conjugal rights petition and ask her to come and join with you in the matrimonial home. Laura is settled in this regard by the huntable Supreme Court. Kindly proceed with the diverse case and you can obtain divorce from the court as per law. Don’t worry you will win.

If divorce is not mutually agreed upon, the petition must be filed by one party and served to the other. The spouse who did not file a petition has 30 days in which to reply to it. After both parties sign the paperwork, it will be submitted to the court.
