Got married last year, almost an year. Didn't register marriage yet but now we need to separate. We don't have any marriage certificate. How to get apart? Do we need to file divorce?
You need to mandatorily obtain a decree of divorce. Registration or non registration of marriage is not relevant. Marrying any other person without obtaining divorce decree will constitute an offence. Also don't fall far divorce by way of making affidavit which is popular practice. It has no legal effect on status of your marriage.
