How can i get divorce for an unregistered marriage

Married 1year ago but registry not done. And we are staying separately after marriage itself. Now want to leave alone as I dont like him at all and i was against these marriage but due to family pressure i have married. So do I required to give divorce or mutual divorce?i thnk divorce is not required as there is s no legal proof.it is a hindu marriage.please clarify

As per the provisions of the Hindu Marriage Act. you have to file a divorce case in family/civil court if possible try for mutual divorce in that case you both have to sign the divorce petition and in case nutually not possible then file from your side it may take 1-2 years and in mutual case it will be within 6 months time

when it is a hindu marriage, and if you have taken the seven rounds before the sacred holy fire termed as saptapadi, defined in section 7(2) of the Hindu marriage act then marriage is complete, only way to part ways is divorce.

If the marriage be a social marriage then there are certain Court process through which you may get divorce after filing proper case before the Ld.Court oterwise it is very difficult to get divorce legally.

If the marriage has not been registered, then divorce is possible. According to the Special Marriage Act of 1954 Section 28 as well as The Divorce Act of1869 Section 10A divorce is granted under mutual authority. A man can also claim maintenance under the Hindu Marriage Act of 2005.
