Hi, nI am an Indian born Australian Citizen living in Australia. My wife is an India Citizen living in India. We were not able to apply for her visa because of her fabricated personal documents and illicit relationship outside marriage. nnIn January 2023, I came to Australia after living in India for 5 years and now my wife has filed false cases on me and my family in India1)Can I go back to India after applying for Anticipatory Bail, so that I cant get arrested. n2)Does Anticipatory bail assures that I can come back to my country and don't need to surrender my AU passport.3) Also any other helpful advice any seniors/Legal representatives can give me before I move to India so that i should be carefulThanks in advance.

my dear client as i can see you issue is really veey serious tht true as well as you can be arreasted also . but we have got the solution for you so that you can be safe and secured as well as you family can also be out of legal trouble and truma as you have mentioned above that your wife is not not at all having valid legal case and all rhe cases she has filles is fabulas and false if we have proof of the fabulasness of the cases and the cases are false tgen we can save you from all the harrasment .

Nature of the cases plays significant role in bail matters. If you get anticipatory bail, you would not be required to surrender your passport or yourself before the police. However this applies only for short duration, depending upon the charges levied upon you. Feel free to contact for better clarification

Yes you need to be careful as there might be a case that an LOC might be issued against you (chances are less but there is no way to find out)
It is advised that you procure an AB first.

In which state has your wife registered FIR ? And under what all sections ?
We need to see the copy of FIR!
In matrimonial disputes wife generally falsely implicate husband, relatives in section 498a, Along with other sections of IPC & dowry act.
They also file Domestic Violence complaint case.
As such police don’t directly arrest in 498a cases until they get approval from higher officials..however to b on the safer side, we can move your anticipatory bail
