Divorce with out Husband acceptance

I need this details for my relative.
Her husband is always torturing after drunk every day and doubting her character. After one big fight he is staying separately now for few months.They have Girl aged 7 years staying with mother. But every day He is calling through phone and asking her to send their kid to their home. Further he is thredening her in phone. He says he will not accept any divorce and he will not allow her to live happily. He is unemployed for Many years and now it is approx 9 years completed after their marriage. Please suggest how to proceed for divorce in this case and suggest how to retain her kid.
the person can go with filing divorce under cruelty ground along with maintenance for herself and her child. the person may also file children custody case before the proper family court or district court or sub court as the case may be
