If my husband files divorce case on a wrong base that i deserted him or refused to take care of his daughter from his first marriage . Or on desertion which is again false as i relocated for job with his consent. In fact i signed a n application form for second installment of education loan to be disbursed this year for his daughter. How can i contest if i don't want to divorce him. I dont want to file rcr since he will never agree to stay with me. Ijust want him to be liable for my maintenance since my present salary is too less to pay emis for personal loans which were taken for his benefits. I am really helpless since my job is also on contract and not permanent. He always tells that he is in debt so cant pay me. Moreover he wants me to sign power of attorney for joint apartment at Bangalore. He insists that he is paying emis for home loan. So he has more share in apartment though the registery is done fifty percent in my name n rest in his name. Whole life i paid emis.
He cannot compel you for EMI.

You should first file an Application under Section 125 of CRPC to get maintainance from your husband. Also if you do not what to give divorce you should contest the divorce Petition filed by him. There is generally a mediation proceeding when a divorce case is filed, you should take advantage of the said mediation and settle the matter as per your requirements.

you can file a petition before the Court to seek maintenance from your husband. It is the duty and responsibility of your husband to maintain your expenses and take care of you and your children. Your husband is dutybound toward you as well as your child.
