Divorce ( muslim Shariah law ) from a woman who doesn't want to leave

I am in a relationship with a married man living separately from his wife since 1 year. She left saying that she wants a divorce and won't come back We were planning to get married knowing she won't come back. She left due to a dispute with the mother in law and threatened she would do something to herself if they won't send her to her parents house We were planning to finalise the divorce in the meanwhile she got to know that the husband is ready to move on with me and leave her. Now she says she wants to come back and apologizes. But won't leave him and if at all he intends to leave her she and her family would file a case against him and are threatening they would go to any level if he is intending to leave her. They have a child together ( 1 year old ) I don't want to leave this man. Please tell me what can we do in Shariah law Because. She will go to any level to file false case and indian system is biased towards women Please answer. Thanks
