Although sex may not be the most important factor for relationship happiness, the absence of sex in a marriage can cause serious issues such as anger, infidelity and communication breakdowns, low self-esteem and isolation. Yes. Definitely. You may file divorce case against your husband on this ground and other grounds also. Not having physical relations is not only a sole ground or pre-requisite to file for a divorce. Pls consult further so that we may advice you other course of actions which you may prefer against your husband.
In order to file divorce you must have some specific ground as enumerated in the concerned statute like adultery, cruelty dessertation etc and burden of proof will be on you and if you are not able to discharge your burden satisfactorily as per law then your petition will be dismissed so you better go for divorce by mutual consent if you and your husband living separately for more than one year at the time of filing petition.

In India, the absence of a physical relationship between husband and wife can be a sensitive issue and may be considered as grounds for divorce under certain circumstances. Here are key points regarding divorce when there is no physical relationship between spouses:
- Grounds for Divorce: In India, the absence of a physical relationship between a husband and wife can be considered a valid ground for divorce. This is often categorized as "sexual desertion" or "no physical relationship" as a form of cruelty or abandonment, which can lead to a divorce petition .
- Willful Refusal or Indifference: To file for divorce on the basis of no physical relationship, it's important to demonstrate that the absence of physical intimacy is due to the willful refusal or indifference of one spouse. Mere physical separation may not be sufficient grounds for divorce; there must be a clear intent to deny physical relations.
- Legal Process: To initiate a divorce on these grounds, one should consult with a legal expert or family lawyer who can guide you through the legal process. The exact procedures and requirements may vary depending on the personal circumstances and applicable laws in India.
- Evidence and Documentation: It's essential to gather evidence to support your case, such as communication records, witnesses, and any other relevant documentation that can substantiate your claim of a lack of physical relationship.
- Counseling and Mediation: In some cases, courts may recommend counseling or mediation to reconcile the spouses before proceeding with a divorce. It's important to consider these options as part of the legal process.
- Language and Jurisdiction: Divorce proceedings should be conducted in accordance with the laws and language of the jurisdiction where the marriage was registered. Understanding the legal framework specific to your region is crucial.
This type of relationship is not a cause for concern if both partners are happy with it. In some cases, the loss of intimacy or sex can cause frustration or pain to one or both partners. If intimacy was once part of a relationship, but it is not anymore, then theres a problem.
