Father of 1yr girl sent divorce notice. I'm now staying with parents n baby.Both of us work in IT but his income is 3 times of mine.how much should he pay for child monthly? Until the maintenance is fixed by court, can he b forced to pay the pending amount? He only pays 10k monthly while actual cost is around 40k

maintenance would be commensurate with the standard of living of the husband if the husband is earning more. if the actuals are 40k then depending on your pay and his it certainly be more than 10k for him. actual amount depends on several factors and cannot be said like that.

no you have to file a case then only he can be made to pay there are 2 specific judgements that will prevail for obtaining maintenance and if he doesnt pay strict action can be taken against husband and for which husband will pay off
