Cavett to stop transfer of divorce case
24-Jun-2023 (In Divorce Law)
I filed divorce case in Pune. Wife and daughter in Kolkata. She did not report on first hearing date. She sent one lawyer from Kolkata and one lawyer from Pune. Pune lawyer signed vakalatnama for her. Now next date is given. My question is she sent one lawyer from Kolkata but he did not file vakalatnama. He came with another Pune lawyer who filed vakalatnama. Is she trying to transfer the case and will use kolktaat lawyer there? How easy or difficult it is to get divorce case transferred to another state? She can cite reasons that her father is ill and daughter is 2.5 years old. Can case be transferred? Should I file caveat to stop it? Will court take my view before transferring or take supreme court order and transfer?
Dear Querist,
Is vakalatnama filed on behalf of your wife in Pune court?
Although she has filed vakalatnama that does not restrict her from filing transfer application in supreme court.
Courts are always inclined towards wife especially with small kids, but you can bear her cost of travelling so that you dont have to skip your work.
It is still advisable to file a caveat in Supreme Court.
