I got married in early july 2017 and my wife deserted me and my family in the month of August 2017 and has never returned. We tried convincing her to come back but she never did and instead her brother tried to raise his hand on me. I wish to know what should be my next steps. When and how can i apply for divorce and ways to waive of 6 months cooling off period to expedite the process of getting a divorce. I am HINDU
Hello, as per the latest guidelines of supreme court if there is no chance of reconciliation and marriage has been irretrievably breakdown than 6 months cooling period can be waive off. But as you have been recently married one year is a mandatory condition either for mutual or contested divorce.

You can file a divorce petition on the grounds of desertion..you have to contest the divorce , if a wife leaves her husband without any justified reason , the husband can rahe divorce on the grounds of desertion.
U can file even now a petition under section 13 H.M.Act but along-with petition, You have to file an application of Section 14 H.M.Act because your marriage was solemnized in 2017. You have to file and exceptional hardship to live with her on grounds of your petition.
