Applied for divorce under sec13ia cruel act

My marriage was on April 2018 wife left from me at 3mnths pregnancy with out any disputes and not joined back after delivering, cast panychath was done with me to bring back her to my house, she was not came then I approached to Legal service authority to bring back her to matrimonial house so many counseling done she not came they issued me a docket order stating to approach court for law then I applied for divorce with my lawyer instructions under 13ia Cruel act. She attended the court and done vakalth:now she was trying to file 498aCase in police station.Si was calling me to come to PS.How can avoid 498A case in ps.

hi
police will not arrest under 498a based on mere complaint.
you should submit proofs of mediation done by elders and DLSA to police to show that you are the victim in marriage and you were forced to file for divorce on grounds of cruelty as your wife was not ready to live with you and infact had deserted you.
also police can give station bail in 498a in case you are supporting the investigation.
please take a support of lawyer prior appearing before police
