498a case after mutual divorce settled in USA

30-Apr-2023 (In Divorce Law)
Can ex-wife's father file a 498a case on me and my parents after ex-wife finalized mutual divorce in USA? Ex-wife is currently in USA, mutual divorce has been finalized in USA 2 months back, along with monetary settlement. She participated in court proceedings, had an attorney of her own and asked for divorce in her counter-petition The divorce decree from USA states each of us will not have any other claim against each other in regards to this marriage. Ex-wife's father wants more money now than what we settled with in USA and a 498a FIR was filed yesterday with false accusations.

hi
since both you and your wife has obtained mutual consent divorce in USA that too with monetary settlement between parties, your ex wife father cannot file 498a in India after date of divorce decree. you need to file a quash petition under 482 cr p.c and quash the FIR filed by your ex father in law. you can also claim for compensation and damages
