My friend went to dubai on tour and lived there at his friend's apartment he was coming back to India almost after 1 month his friend brought his ticket and said that there is a company in Dubai which provides free tickets to travell back to native country but in return you need to take some luggage and give it to a appointed person in reaching to your country and that the luggage is totally safe and their company is also well known . So my friend agreed to this and returned to India the person who gave him ticket also gave him a metal hammer to take with him and give to the appointed person outside the airport but when my friend reached the airport he was captured and came to know that the hammer cotained gold rods of approx 1 kg weight he was charged under customs act and has been sent to jail and is under trial . Can he get bail and if yes then in how many days maximum. And how and when to file for bail . Please help and we also need a lawyer. So please help.

the offence is bailable and the bail can be granted in the first hearing itself as the person is not evading a duty of 50 lakhs and above and also as per customs act 1962 gold is not a prohibited good... these grounds are enough for getting bail. also that you can claim the gold too after paying the duty as the person carrying it can claim ownership as per customs act.
