What to do if the police does not follow courts order

23-Jun-2023 (In Criminal Law)
Sir A lady had obtained final police protection order & residence order from the court of the Judicial Magistrate under the P.W.D.V Act & the said case was disposed of in 2018 by directing her brother will not disturb, not to commit any acts of domestic violence on the victim lady , not to insult her ,not to evict from her father's when she resides at present , no to disconnect the electricity connection of her room & the court also directed the O/C of the local P.S to provide necessary protection & assistance to such victim lady if she needs at any time but her brother continiously torturing upon her by mentally & physically day by day but she is still lodging several complaints to the local P.S for seeking protection on the basis of such court order but unfortunate, that the O.C is not giving any protection. The said court order is being violated by the police & the O.P so in this situation can she go to the High Court on the basis of such order? Is it possible according to law ?

file police in action in form of a writ against the police, hope you have written documents that police has not been been providing protection. Moreso, if electricity is disconnected, get hold of the record why it has been disconnected, it will help you to move before high court or any higher forum of law.

Yes you file a writ under Article 226 of the Constitution of India for police inaction.you can also file a case for contempt of court against the officer in charge whome direction was given by the judicial magistrate for violation of the solemn order.
