What happens to the property of abettor when he dies

One of my friend is accused of da case by cbi .his father was called the abettor .he had properties in his name that was added to the accused now his father died .What happens to his fathers property first next as his case was a da case with his fathers property now without his fathers property can cbi give a b report?

the person has to make a writ of manadamous before the high court or criminal court where the case is under trial. if it is DA then the legal heir may contest to get the property or it is not available to them
