What action can be taken legally in domestic violence
24-Sep-2023 (In Criminal Law)
My sister's husband and Inlaws have been physically, verbally, mentally abusing her since her marriage 3 years ago. She is a Muslim nri residing in ksa for last 2 years where she faced lot of beatings from her husband. She tried to complain locally in ksa where the authorities gave him a last warning to stop his misbehavior or else he will be jailed there. He will not change and to evade punishment in future he now plans to leave my sister in hyderabad with his parents who are equally abusive. My sisters life is in danger if she stays in Inlaws house as they will continue to abuse her. What action can be taken legally against her husband and Inlaws to safeguard my sister's life as she has suffered a lot
Hi
On behalf of your sister, your mother can file a case of Domestic violence in the courts and also seek protection from your sister's in laws under domestic violence.
a) Your sister is entitled to get residence order under section 19 of the Protection of Woman from Domestic Violence Act (DV Act) and reside in the matrimonial home with dignity.
b) Obtain protection order under section 18 of Protection of Woman from Domestic Violence Act (DV Act) prohibiting the in laws from committing any act of domestic violence against your sister and further prohibiting the husband from alienating the assets both moveable and immoveable properties owned by him
