Tiger Reserve area case in madhai zone
12-Feb-2023 (In Criminal Law)
Session Court se bail kharij ho gai h ab high court me appeal krdi h usme heraring kitne dino ke andar hoti h.
As for as I concern I will give you my best advice that if bail has been rejected from the session court then you can file same application in the high court suppose bail has been rejected in section 439 of crpc where accused is in jail so you can file bail application under section 439 of crpc before high court, if bail application has been rejected in section 438 of crpc you will have to be file under sect 438 of crpc in high court. So for as the time period is concerned to decide the bail application I will tell you that mostly it does not take more then a weak if court is ready to grant bail otherwise court can say that you try after some time. You can file bail application any time in the high court after rejecting from the trial court.
i hope this advice will help you to understand and face the problem. If any other enquiry you can post your enquiry on my profile.
