My employer not paying substantial allowances due to absenteeism during Covid 19 pandemic. Is non payment of substantial allowances covered under criminal act?
Well, it is not a Criminal Act. However, you can recover your substantial allowances from your Employer by filing a case in Labour Court or NCLT. You can also file a Summary Suit in Civil Court to recover your Substantial Allowances. Any legal process to file a case starts with a Notice. So, in your case too, I will send a Notice first for and on your behalf to recover your outstanding substantial allowances.
