Ndps Section 27(b) case Effect after paying the penalty

I haven been convicted for ndps 27(b) in 2021. And now summons is been issued. After paying the fine in the court will the case be over. Can i get visa for abroad travel or will this effect my visa applications in future. Im a CEO and Founder of travel agency.

Here's a simplified explanation of Section 27(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985:

If someone is found consuming narcotic drugs or psychotropic substances that are not listed under Section 27(a) (which includes more dangerous or heavily restricted substances), they can be:

  • Imprisoned for up to six months,

  • Or fined up to Rs10,000,

  • Or both.

This section is generally used for less severe drug use cases, like possession or personal consumption of drugs that are not considered the most dangerous under the law. It?s still a punishable offense, but the punishment is relatively lighter compared to more serious offenses under the NDPS Act.

The offences falling under Section 27 B of the NDPS Act is a non-bailable offence. Hence this will certainly reflect in the Police clearance certificate. However, as this case come under petty offence i.e. consumption of only 1 gram , then it will not effect your visa application

Dear Sir, It are asked to pay fine only then you have not hurdles in going abroad and getting the Visa etc. But police may say that it is heinous offence and may not issue Police Clearance Certificate. In such case you have to approach the High Court and get some favorable order. Any way you have a merited case if case ends in payment of fine only.
