Left company formally by affidavit but dealers harassing by calling

07-Jul-2023 (In Criminal Law)
i have left a company with mutual consent with my partner before notary public affidavit siliguri. and published the information in a news paper too. in the deed of dissolution it was clearly stated that from then all the liabilities will be exclusively carried by the another partner under his proprietorship control. After 3-4 months my ex-partner closed his business and office without returning the SD & commissions to the dealers. Now the dealers are continuously harrasing me that they have joined this business in my words, so i should pay their dues. My ex partner told them i have cheated him and thats why he has closed office and business. when i was associated with the firm i have made some dealers but left the business in a faith that my partner will continue the business. i am fade up with the phone calls of the dealers and all so i have off my phone. What to do now?

Contact the local lawyer at Siliguri and proceed the matter. For discussion sake, bear in mind that all liabilities will cease to have any effect from the day the partnership firm was dissolved and duly promulgated in the local newspaper. However, any liability arising from any transactions which were subsisting during the existence of the firm will continue and a partner will not be absolved from such liability merely on the ground its been dissolved. However, you will not be responsible for any transaction taking place between your ex-partner and dealers after due promulation in the newspaper of its dissolution. If that be the case, you should lodge a complaint with the local police station, and initiate a criminal proceeding u/s 420 and 406 IPC against your ex-partner and also lodge a complaint against all those dealers who are threatening you u/s 506.
