What are the condition for bail granted in sec 304 b and 498a ipc ?

Sec 304b & 498a both are non- bailable offence.it can b applied anticipatory bail if not arrested under sec 438 and regular bail if arrested under sec 439 at district session judge court or high court.if rejected by the sdjm court.

There is no such certain formula to obtain bail. It depends upon the situation and proximity of accused with the deceased , in such type of cases every case is a different case. If you can prove and satisfy the court you have nothing to do with the case or allegation then chances are there.

No inflexible guidelines or straitjacket formula can be provided for grant or refusal of anticipatory bail.The nature and gravity of the accusation and the exact role of the accused besides many other aspects is looked by judges to allow bail

Granting of bail and the conditions for granting of bail is dependent upon the facts of the case but if you are inside custody the approach Honorable high court under the provision of 439 crpc or if you are outside the file bail under 438 crpc
