Filing a case against husband for adultery & to claim for alimony

I am a hindu female married for 2 yrs .. My husband is having an affair with a girl and they are physical too as per the sources. They both started a business a year ago about which my husband didn't told me till date. They both work in that office in the day time and spend time in the rented room in evening. He tells me that he is going to work about which I know but he straight away land to his business place. I wanted to know that if I file a case I wanted to involve that girl too and should I get the alimony if he says he is unemployed? Because the original about which I know he said he is resigning. May b because he will then fool me and he will work with that lady. Kindly do let me know all the measures and actions I can take against both of them.

Yes u can file an adultery case but u have to collect evidences before that.
Permanent alimony is not as easy until both get agree.
First try to get divorce through mutual consent.
If he does not give up then try to collect evidence then file divorce on that ground.

Hi. Mam... U have lot of legal action against ur husband..... Maintenance case against ur husband. And one case u can filed against ur husband adultary And u can also file dv case..and can a fir 498 a ipc also....

You can get alimony and maintenance. Your husband will certainly say that he is unemployed and has not income. Therefore, keep his employment, business and income proofs with you, especially, his ITR details, Employment letter, Bank statement and passbooks, list of assets/property details, sources of other income etc.
As far as relationship with other female is concerned, unfortunately, this is not an offence in India. But, if the girl is married, her husband can take action against your husband. But, this is certainly a ground for divorce or judicial separation and a justification for living away from your husband, if you want to avail any of these remedies.

There will be no Alimony in the event of adultery. The court must be convinced that one spouse is unfaithful. Alimony will not be paid or only a small amount if the marriage ends quickly. The amount of support in divorce will increase the longer the marriage has lasted.
