I established a physical relationship with a married women.but she don't know I'm also married.I hide my marriage status.but I can't promise him to married.I want to leave this relationship because I understand its a wrong way.but she blackmaling me to file rape case.can it consider to rape??

hello client as i can see the issue which you are facing is a matter which is clearly a illegal affair as well as extra maritial affair. in this matter we can help you for sure but we need to have full evecences tht she is in physical relationship with you with her free will .

yes it consider as rape it's comes under 376 (2)n .... immediately file a complain for your safety..
if she file complain than you have to prove yourself inocent... and during these all you have to face many problems contact us for exact advice.

Yes…that’s comes under the preview of rape under section 376 IPC. If she’s blackmailing you then keep the blackmailing chats/calls in safe custody because it may help you if she does anything nasty. For more legal assistance I am just a call away.

if two major persons volunteerily have sexual intersourse then in such circumstances no case of rape is made out. However, details and various aspects are required to be examined in detail in order to ascertain the situation and also to suggest remedy. so if required consult with detail.

If you can show consent, rape may not be made out. However, if she chooses to file a complaint against you under 376,the police would be virtually obligated to convert that complaint into FIR as Lalita Kumari judgment mandates registration of FIR in such cases. If the physical relationship was consensual, then no criminal offence should be made out. Joseph Shine judgment of the Supreme court has already decriminalised adultery. Adultery, though, is a ground for divorce.
