Compromise a crminal case when requested by the other party
06-Jan-2023 (In Criminal Law)
Is case compromise done before a judge or does it happen between two individuals with the presence of lawyer
In out of the Court Settlement matters, usually, parties can settle their matters through Mediation/Arbitration/Conciliation. In Mediation, presence and role of Mediator is quite important. He is the one who settles the matters between the parties. A Mediator doesn't need to be a lawyer mandatorily. He can be an Individual from Civil Society or any person having the capability to resolve the dispute between/amongst the parties. As facts & technicalities of every dispute are quite different from the others, so there is no need to put a lawyer in place always in each and every dispute for Dispute-Resolution. However, if parties decide to put the lawyers in dispute for resolution, then it is best.
Whereas Arbitration & Conciliation are quite different methods of Dispute Resolution but falls under the
Statutory Laws of India under the concerned acts.
