Cheated by Boyfriend on promise of Marriage

I have been in a relationship with a guy for around one year.He contacted me through Facebook. We met and then we came into a relationship. I was living in a PG and then he made me shift to a rented apartment . then he visited me every saturday and sunday. He promised me many times that he will marry me but now denying that. He told his family that i am a bad girl and forcing him to be with me . Now he has closed all the contacts and switched the mobile. I am suffering from a mental trauma and want punishment for him.

hello client hey as Ur saying a tht a person who convinceed u to be friend through Facebook and after tht you both meet and b come good friends of each other and latter on he promised you to get married to you and after tht he tried to take advantage of urs and came into relationship with you he also shifted you from your of to an apartment where he is to visit daily and after tht in present running he is neglecteing you and telling his parents tht Ur a bad girl and Ur forcing him to live with him in this sinario you have to take legal action against him and teach him lesson tht is the best way.

Regarding your query.

You can raise a complaint against him at near by police station under Sections 420, 376 and other various sections of the Indian Penal Code. You can also institute a case against him at the Court and have it filed through a lawyer.

However please note that the onus to prove that he promised to marry you must be strong, records of conversations, videos vide which your case will be proved must be strong for the Court to pursue. The Court should not feel that the present situation is that of a jilted lover.

it is sad that sex in the pretext of marriage has not been declared rape in our country.. but there are other ways to get him punished. for that I need some details from you there are many provisions in law under which we can drag him to the court but choosing the right provision would get him punished.. so I need more details of your relationship

In this regard, i want to know whether there are physical relations with you and him? If yes, then certainly it means that he has forced you under the said sexual intercourse on the pretext of false marriage. For this kind of act, you can very well maintain a criminal complaint for rape under Section 376 of Indian penal Code, 1860 and can seek registration of FIR in the concerned Police station. What we know so far: A man who promises to marry a girl but does not intend to do so, yet has 'consensual sex' with her will be charged under Section 69 in the proposed Bharatiya Nyaya Sanhita 2023.
