Can I not go to the court after receiving the summons

03-Aug-2023 (In Criminal Law)
Hi, Actually we had a fight with our neighbours six months back. They came to my home and hurted my dad and he had some minor injuries in his right hand. So we lodged a FIR against them under IPC section 323,452,506 and 34. They arrested by Police and took two days in the prison as ordered by the court. After coming out from prison they feel sorry in front of police and gram panchayat and we had compromised with them. Now after six months we got summons from court for final witness on the name of me and my father, while i was not involved in the case and i didn't lodged any FIR against them. So we did not go to the court for witness. The accused are threatening and making pressure for compromise on us again and again. In this month we got again summons from court for witness. So i just wanted to ask that if we don't go to the court after receiving the summon second time, then what will happen. We don't want to do any type of compromise with them for atleast 3-4 months.

If you don't go to court this time, you will receive warrant from the court to secure your presence before the court.if you dont attend the court even after warrant, then court will issue arrest warrant.its upto you to compromise with them or not.

In India, if a person does not respond to a summons to court, the court can proceed with the case without them. A default judgment can be issued in India if a person fails to respond to a court summons.
