About penalty break policy of company

In agreement, they haven't mentioned any such thing like if employee are leaving within 11 months need to pay penalty chargers.Now they are demanding for it.And they are saying they will file case under section 406 and420.

Dear Querist

perusal of agreement will be required for the issue shared by you. However, assuming that your employment agreement does not consists of penalty charges, the same cannot be claimed by company.
In case, if the company desires to file / have filed complaint under section 406 / 420 of IPc than, I'm my opinion you should first apply for anticipatory bail and thereafter defend the complaint where it is filed.
