What to do if Claim is not getting honoured in NCDRC
27-Sep-2023 (In Consumer Court Law)
A person got his electrical products insured for more than 1 Cr. through a private insurance company in India...After a few months, his shop got burnt and/ or looted by 2 of his known people with ill intent, 1 of whom died on the spot accidentally and other badly burnt. The person whose shop was burnt has zero knowledge of the same and was made the main accused in it and sent to judicial custody for 100 days or so. He wanted to claim the insurance for the same as everything got burnt and had no means of other income. Insurance co. rejected citing that He was made main accused in it and he did not file for claim in 45 days. Since the matter is of more than 1 Cr, it went to NCDRC, which has again pointed that he was made prime accused and would only be allowed once his main criminal case is decided in concerned Criminal court. He seems depressed, claims he is falsely implicated, has zero source of income and is helpless. What remedies does he have? Thanks.
the criminal court proceedings has to be completed and the person against whom criminal charge filed should come out with clean hand that he was ignorant of so called theft or fire. the badly burnt person is main in this case
