What should i do if builder not keeping up with his promise.

01-Dec-2023 (In Consumer Court Law)
I bought a 3 bedroom flat 3 years back. I am entitled for 2 parking slots. there is parking space available in ground floor as well as cellar. Builder promised me to give one parking in ground floor and one in cellar. Everyone got parking in ground floor except me. Both parkings are allotted for me in cellar which is steep and difficult to drive for ladies. Builder is not responding as i have paid the entire amount. Can i proceed legally against builder? Please advise.

Yes, ofcourse if that promise is in Agreement rather than orally. Approach the consumer forum and you can get the relief. Try to issue a detailed legal notice through a lawyer if possible then approach the consumer forum.

Hello,

If the talks with the builder is not fruitful, send a legal notice to him through an advocate and demand parking in ground floor as per the agreement. If there is no action at his end, file a complaint in consumer forum and proceed further. Feel free to contact me for any assistance.

I can only advice based on your words as . Generally you have a title deed which clearly describes about the flat details along parking space. U can verify under recent passed builders act passed in Parliament . And can seek an Damages for improper information. Possibility of winning case purely relies upon documents you submit
