What is the process and procedure of defending a case in NCDRC?

Dear sir, I have won the case against a builder in state consumer forum in Karnataka. Now that builder has challenged that in the national forum. Please clarify my below doubts 1 – Can I defend/ represent myself in national forum. Without the help of a lawyer. 2- Can I reply to a court notice through a post? I stay in Karnataka, so that i dont need to travel to delhi. 3- what would be the average/ approximate fee of the lawyers in handling this case. Thanks

Yes you have the right to defend to your case. NCDRC can not proceed without making you a party to the Application/Appeal filed by your builder in which your substantive rights are affected.
You may file reply through your counsel.

Hi, in your case, My reply is as follows ;
1.You can represent yourself but my suggestion to you is that engage some lawyer for the same as there are so much legal formalities and drafts have to made for the same.
2.No, you have to appear in person or by an advocate as your counsel take exemption for your appearance.
3.It will be negotiable, when you will discuss with someone.

1) yes you can defend your own case in person without an advocate in the national commission
2) if you represent your own case you will have to appear before the court
3) the fee would depend from advocate and you can add litigation charges as well as travelling expenses in your prayer.

Dear Sir,
Yes, you can fight your case without a lawyer but you will have to be personally present in all the hearings.You can not send the replies through post. The cost can only be quoted once a lawyer goes through your case papers.
