What can be done if HolidayClub gave membership making false promises?

I purchased Country Club membership by falling in trap of several false promises done by their sales agent. Since then I tried to escalate the matter many times whereas no steps has been taken by them and no satisfactory answer has been provided. I am also unable to use the membership as now they want more money in lieu of AMC(Annual Maintenance charge) and other charges. Please advice

Sir there are two legal remedies available to you. The first one would be to approach a civil court in this regard to claim damages. The other would be to approach a consumer court on account of deficiency in services. The second option would be a shorter route and there are better chances of redressal. Further if they have cheated you or played a fraud you may file a complaint. That could only be said once I have gone through your file. Regards.

You can explore a number of options which will depend on what exactly it is that you are seeking. From filing a criminal complaint to filing a consumer complaint, any option can be explored. A lot will depend on the facts of the case too. Some of these places add an arbitration clause to the agreement. In such situations, arbitration is also another possibility that can be explored.

Depending on the terms of the agreement, a consumer complaint may be filed at the District, State or National Commission, depending upon the financial value of the Complaint, for unfair trade practice and deficiency of service (among other things). I would be in a better position to help after understanding the precise facts of the case.

Whatever the agent promised you, do you have that in written form of contract or otherwise. If yes then, it will be a cake walk otherwise it will be little hectic but somehow we will manage it. As it is required to prove in cross examination in consumer court.
