Various charges levied by builder under pre posession charges

Q-Can builder give posession of flat in multistorey appt before getting completion certificate from authority? Q-are interest charges levied on demand charges( under construction link plan) justifiable under condition of excessive late projects? Q-Under change of project layout what recourse is available to me if their is no sunlight condition as building in front has come up.?

I would like to give you answer of your questions.
Ans.- Builder can't give possession before completion certificate.
Ans. - builder is liable for paid late possession fee or interest.
Ans. - builder can not change without your permission or settlement.
You should be file a consumer complaints in consumer Court against the builder.

1. It depends on the state which the flat is situated, this has been a usual practice the builders follow and depending on how it is affecting you in current situation the answer will vary .

3. If you are not satisfied with what the builder has provided you despite having promised something on basis of a payment already taken then you can approach the Consumer Forum easily to figure a solution.

1. No a builder can not offer possession without taking completion certificate
2. Yes if any previous demand was not paid on time the builder will levy interest charges - check the delay in possession clause and match it with your demand letters you might get some answers
3. you can file criminal as well as civil complaints

you can file a consumer case, as well as cheating against the developer. Check the original layout by filing RTI in the Development office followed by challanging the change in layout of the project.
