Showroom sold an old bike without informing me
07-Sep-2023 (In Consumer Court Law)
I bought a Suzuki gixxer sf 155 on March 31 2021 which was billed on April 1 2021. But after a month I found the bike was manufactured on september 2020. When I enquired about this i got no proper response till date. After 1000 kms bike started giving trouble and I had to take my bike to service centre several times and after so many tries service centre people accepted that there is some issue with the bike on 3rd september. Now my bike completed around 4500 kms. When I talk to the showroom representatives they are saying they will take care of the issue in engine as the bike is under warranty but they can't do anything about selling a seven months old bike as there is no expiry for the bikes manufactured. Is there any law prohibiting or allowing the sale of bikes manufactured on the previous year? Can I ask them for refund/replacement or sue them as they sold me the bike manufactured on the previous year without informing me? Thank you
In this case, I would like to know what manufacturing year mentioned in the RC card and further replacing the entire thing is not possible but we demand replacement engine and service charges get a waiver. I have a vast practice in that area you can seek my assistance in your matter.
