RWA threatening to discontinue of service for non payment

21-Sep-2023 (In Consumer Court Law)
Hi, Hi I reside in Gurgaon and my Last month the rwa in my society forcibly took over the maintenance from the developer. Now they same is being fought in court. Following courts interim judgement the maintenance is being handled by rwa. Earlier the bills were being generated for three months at the rate of 2.05 psf but now the rwa is charging six months and that too at a much higher rate of 3.5 psf. The rwa is threatening discontinuation of services on non payment. Kindly suggest the legal options available

RWA cannot cut essential service, there are court judgments on the subject. You can ask for account details of maintenance charges from RWA. If you are not convinced, you can move the court but that is an extreme step and not very effective because court will be reluctant to interfere. Moreover, if it is a good society then the charges mentioned by you are not very high. It is better to resolve the issue through other members of the society. You must not stop paying the maintenance charges, it will weaken your case.

Hi,
firstly check your agreement with RWA for services and if it is not as per the contractual conditions then file a suit for breach of conditions in civil court and you have the option to make a report to police or complaint to magistrate in criminal case of cheating and breach of trust and you can also file a complaint in consumer forum

Thanks & Regards
