Reporting to CIBIL after 30 days of closure of Loan Account

27-May-2023 (In Consumer Court Law)
Brief Facts - The Loan was taken from A Bank. It was settled in 2012. Payment made as per Settlement. Thereafter A Bank assigned the said settled & closed Loan to B Bank, then B Bank started reporting to CIBIL, showing as default from 2012 to 2014 for 900 days. The last Reporting & Certified date done by B Bank in the CIBIL is Oct 2014. Whether the assignment of Closed & Settled Loan and then reporting after 2 years to CIBIL is not against the Section 22 of The Credit Information Companies Rules 2006, which says that reporting must be done within 30 days of closure of Loan account ? Whether the Borrower is entitled to invoke the jurisdiction of the Consumer Court for deficiency in service by A & B Bank and deletion of name from CIBIL ? Whether it is necessary to array the "CIBIL" as party in complaint ?

Yes it's clear case of deficiency of service, it will score you negative in your CIBIL report, you must get It rectified.
File your complaint to Consumer Forum, and both parties are necessary parties.
Bank have to pay damages for wrong reporting and CIBIL have to rectifyit in its record. For more info fee free to call

Sir, you have not clarified if the No Dues Certificate was issued to you by Bank "a" or not otherwise there is apparently no point in assigning a settled and closed account, if actually it is so, it is a sure case of negligence and deficiency of service by both the banks, you can file consumer complaint. There is no need to array CIBIL as a party as it acts on the instructions/ information provided by the banks only.
