Remedy as vehicle purchased already sold to another person before
25-Mar-2023 (In Consumer Court Law)
2 years after purchase of activa, i found on official records through activa service centre that the activa was sold to someone prior too. though the registration is in my name, but it clearly shows that the vehicle was sold 6 months earlier to someone else. can i hook in the head office because primarily they told me that the activa is new when i had doubts?
Yes, you can. But first you need to collect the record of the service centre which shows the date of selling and the name of the person to whom they had previously sold the said activa. Thereafter you can file a complaint against the company as well as against the seller against the cheating done with you.
Yes IF you have purchased brand new activa I should be on your name only and now prior owner can exist. If company has sold any second hand vehicle to you then they have committed fraud and cheating . You can register complaint under section 12 of consumer protection act in District consumer forum.
You can firstly serve the seller a notice and if even after that no action is taken by them. You should file a consumer case at the local jurisdiction from where you bought the said vehicle and claim compensation. Also you can file a criminal complaint under section 420 417 468IPC and get registered an FIR against the company.
