Refund of booking amount in an institution not under ugc or aictc
23-Apr-2023 (In Consumer Court Law)
I had booked a seat after giving the exam for pre sea training course back in December 2019. I could not join the course and had notified them a week before the commencement. They transferred the seat to a waiting candidate and are also refusing refund of 25000 as they had mentioned in prospectus. I am not sure if I can send them a legal notice or they will drag me in the name of defamation lawsuit. Considering extra hefty fee for legal notice and possible consumer court battle, what chances do I have here to recover that amount. I am in need of money and feeling helpless due to covid 19 shutdown.
Sir.. For this the copy of prospectus has to be read carefully to identify all the terms and conditions.
See there is no harm in providing legal notice. As far as defamation is concerned, no need to worry about that as it is having different requisites.. So go ahead and claim your refund, but before that please see prospects carefully.
well, it depends upon terms & conditions of the executed/signed application form. anyway, certain amount can be forfeited but deducting whole paid amount is wrong, null and void.
Thus, you shall send a legal notice to receive your hard earned money.
Defamation issue has no significance in your case, as per the shared facts.
you may get in touch with me for legal notice.
Regards
