Refund of advance paid for order party did not deliver or make refund
29-May-2023 (In Consumer Court Law)
What is the best course of action for the recovery of advance and compensation for the losses suffered along with up to date onterst? Is lodging a complaint with the district consumer forum the first step? Is it necessary to send the notice before filing complaint by registered post? What is the percentage of interst that can be claimed? Is criminal legal proceedings necessary for recovery and if so is it necessary to proceed with both together? What is the time frame for recovery in both the above process? What could be the approximate legal cost? Is it ok to proceed without an advocate?
Hi,
You can approach Consumer Forum for adequate compensation as well as you can initiate proceedings under criminal law. However, it is my best advise that you must proceed through an Advocate , other wise your much money and time will be consumed (as good as , self treatment for a disease with out a doctor!) . The other details can be communicated to you in a later stage ,so please feel free to contact me at time.

From you querry it is not clear about the cause or reason for loss .. In general you may approach the CDRF, prior regd. notice is not necessary. Normally 6-9 % interest will be allowed, even if you asked more. it may take 1-3 years for the disposal of petition filed by you by CDRF-subject to the business of work-. Rs.100/- by way of PO to be submitted at the time of filing. And they you have to deposit extra cost if any during the trial for any other process and expences...?
