Received damage items from E-Commerce website what action can I take

Dear Sir/Madam We have recently purchase a TV with 50cm from one of the leading E-Commerce website. We have notify the company and raise the complain under the 7 days return policy, The company after keep promising to take action nothing is been done. Please advise what next step we can take. Its kind of 1) Mental harassment 2) Loosing trust on all E-Commerce website 3) Bit Frustrated after repeated calls to the company Will appreciate if you can give us your valuable advise

We cam file a consumer complaint under section 12of the consumer protection act, 1986. We can further in prayer can claim damages, compemsation for mental harasment, legal cost. I have been dealing plethora of cases.

In my opinion you shall first give the company a legal notice asking them to resolve the complaint within 15 days. In case they fail to comply then you shall proceed with a complaint in the consumer forum (if you have purchased the product for personal use) alleging deficiency in service and goods. Here you can ask for refund, damages if any, compensation for harassment and cost of litigation.
In case you have purchased this product for commercial use then you will have to file a civil suit.

send a legal notice to the company, seller and the brand as I am assuming you ordered this from a marketplace. If nothing happens you can proceed against them in consumer forum and all your concerns can be raised in the forum and the legal notice.
