Possession not given by builder

I have booked a flat in the year 2011 by made the booking amount of Rs.25000/- to M/s Samiah International Builder Pvt.Ltd., Noida(UP) in their Gulmohar Estate-II Project which is located at Kashipur Road, Rudrapur, Uttrakhand. As per their words of giving the possession within the year we were paid the total amount of Rs.467000/- against the total flat amount of Rs.480000/- up to the period of November'2012 but they didn't given the possession till date. Now I want to my money back from them because I think they don't have any intention to give the possession of the said flat. So please tell me how can I file the case against them in the consumer court and how much the fee of the advocate if I hired someone.
instead of going in consumer forum you should proceed to special rera court which is stablished for this specific purpose. there the procedure is fast and simple along with this you can file the criminal case against your builder under sec 406 and 420 of IPC . as for as you engage any lawyer he will charge in between 15 to 20 thousand including expenses.

you can approach the state Commission as well as the real estate regulatory authority against your grievances. the RERA will only allow interest till actual possession is handed over whereas in Commission you can claim other things too from the promoter
