Poor services by company can I file consumer case

Dear sir/madam, I have taken Annual maintenance with a water purifier company. As per the AMC they should provide me free services for one year and also if any parts should be changed it would be done free of cost.They taken RS.5000 for AM. It was taken by me on 1/3/2016. being 9 months they did not even turned for single service when ever i contact their phone no it may be either busy or not attended. in between i have change machine parts twice with other providers which should have done by that company. Now my question is can I file a case under consumer court as i have 3 more months validity for that receipt. And also want to know whether how much cost would take this procedure.

Before formally filing a Consumer Complaint, it is desired that the Consumer gives notice to the opposite party of the fact of any deficiency in service or of unfair trade practice etc to see if the trader is willing to make good the loss suffered by either replacing the commodity.

Under the Consumer Protection Act you can file a complaint against the company for deficiency in services and unfair trade practice and also claim damages from the company for the mental harassment suffered by you because of the act of the Company.
The cost depends on various aspects such court-fee, services of a lawyer, if any.
