Penalty for personal cargo coming in after 365 days of my last entry

1) Is there a penalty to be given to the customs office if your personal items cargo (all used items) is shipped and delivered 390days after your last entry into India?
I entered India in march 2020. Global borders were shut and my company also ran into losses and put me on unpaid leave for 11 months. Then Feb 2021 I lost my job. They packed and shipped my items and finally it arrived Mumbai in April 2021. I came to collect my cargo on same day, but I was told that I have to pay penalty of 5k to 10k because it exceeded 365 since my last entry. What wrong have I done that I am charged a penalty?
2) From when should I get charged for demurrage? Do I have free days before they start charging me?
Well, you must have violated rules, otherwise Custom Authorities won't charge anyone unnecessarily. You have passed through the Green Channel with Dutiable items in your Baggage without informing in advance about such Dutiable items to the Customs Authority. That's why they have penalised you.
