Negligence by government hospital how can i claim compensastion

My father was admitted in Aiims for a simple kidney dialysis. He was a BP patient and there was no BP monitor also attached to his bed. He died of gross negligence and aggressive dialysis treatment . Would like to know limitation period and remedy.

There are two routes which you may wish to take. One, is medical negligence under criminal law where even a doctor can be held liable if his/her conduct was below reasonable care. The second route is to file for compensation before either the National/State/District Consumer Courts depending upon the value of your claim. The case can be filed within 2 years of the cause of action i. e. incident occurring.

within 2 years you can file a complaint in consumer court, first you have to file a compliant before medical council with all the papers medial which you relied upon the medial negligence. please also file a criminal complaint against the responsible person(s) or doctor.
