MOU signed in court not honored by builder

15-Mar-2023 (In Consumer Court Law)
We had a consumer case against our builder for deficiency in service. We reached an out of court settlement and the MOU was signed in court. Its been 2.5 years since then and the builder has not honored the MOU. Would like to know the way forward.

As you informed under the consumer complaint you have settleed out matter by MOU.

Here you have three option

1) you can file a execution petition for executing the compramise/settlement decree.

2) you ca re open the same case for breach of compramise terms

3) you have better remedy before the RERA against theae kind of builders.

If you provide us the details of comprmise terms and order paased on your MOU as aforasaid we can help you. Since the matter is civil in nature we need to go through document to give better solutions to you.

If the order sheet mentions that there is settlement and builder agreed to repay the amount in case he doesnt you can proceed for execution against him or can file a fresh petition against him for unfair trade practice again
